OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. The “Win Dave’s Gear” giveaway (the “Promotion”) begins when pre-orders go on sale and ends when a total of 3000 entrants has been received in combination of “On Revolute” physical discs sold directly from daveweiner.com and no-purchase necessary entries (the “Promotion Period”). The (“Sponsor”) is Dave Weiner and Revolute Records, LLC. Rules may change at anytime. Prizes may change at anytime. This giveaway may end at anytime.
ELIGIBILITY: To participate in this Promotion, you must be at least 16 years of age at time of entry. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
HOW TO ENTER: There are two ways to enter the Promotion: 1) Purchase the “On Revolute” physical cd (the “cd”) directly from daveweiner.com (http://www.daveweiner.com/store). The information you provide in your order and/or through your paypal account (name, address, email address) will be recorded and added to the eligible participant’s list. By purchasing the cd, you agree to and accept the terms of the Official Rules and submit; or 2) To enter without making a purchase, simply join “Dave’s Newsletter” or send a 3×5 postcard of any kind with your full name, mailing address, phone number, email address and date of birth to: Revolute Records, 15134 Moorpark St., Suite 204, Sherman Oaks, CA 91403, USA. Once we receive your information, it will be added to the eligible participant’s list. By signing up for the Newsletter or submitting a postcard, you agree to and accept the terms of the Official Rules.
Only winners will be contacted and notified via email. Winner has 24 hours to respond to notification until his/her prize is then given to another eligible winner through another drawing. In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The “authorized account holder” is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries made by any other individual or entity that is not the person named on the submitted entry, or made in any manner inconsistent with these Official Rules, will be declared invalid and disqualified from this Promotion. All winning claims are subject to verification by Sponsor and/or the Administrator, whose decisions are binding. Even if the drawing shows that you are a winner, you are not a winner until your eligibility has been verified. No proof of winning will be accepted. Only the Promotion Administrator’s verification process shall be conclusive and final.

WINNER SELECTION AND NOTIFICATION: Prize winners will be selected, from among all eligible entries received, in a random drawing to be held on specified dates announced on daveweiner.com or a social avenue such as Dave’s Facebook page. Each entry is given a number in a database. A random number generator is used to select a number. The entrant who’s assigned number matches the selected number, is the winner of the prize being offered at that specific period. Odds of winning depend on the total number of eligible entries received at the time of the drawing; not to be more than 3,000.
PRIZE CONDITIONS: No prize substitution or cash equivalent of any prize is permitted, except at the sole discretion of Sponsor, who reserves the right to substitute any prize offered with one of equal or greater value. Sponsor will not replace any lost or stolen prizes. Winners are responsible for any loss of prize after it has been delivered. Prizes will be mailed to the address provided at entry within 6-8 weeks from the end of the Promotion Period. All federal, state, or other tax liabilities, if applicable, are the sole responsibility of the prizewinner. If any prize is returned as undeliverable, this will result in disqualification and an alternate winner may be selected.
TERMS AND CONDITIONS: This Promotion is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in regard to the Promotion mechanics, and/or the interpretation of these Official Rules. All entrants, and any selected winners, agree to release, discharge, indemnify and hold harmless the Sponsor, any vendors/prize providers that may be associated with this promotion, and the respective officers and employees of these entities, from and against any claims, damages or liability due to any injuries, damages or losses to any person or property of any kind resulting in whole or in any part, directly or indirectly, from participation in this promotion, or for any prizes won.
PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTY, GUARANTEE OR REPRESENTATION OF ANY KIND, EXPRESSED OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).
LIMITATIONS OF LIABILITY: Incomplete, corrupted or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for incomplete, lost, untimely, illegible, or otherwise destroyed or corrupted entries or entry requests or for incomplete, lost, interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone transmission problems or technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. The Website’s database clock will be the official timekeeper for this Promotion. Sponsor reserves the right at its sole discretion to modify or cancel this Promotion at any time for any reason without notice or obligation. Sponsor, its affiliate companies, parents, subsidiaries, officers, directors, and agents are not responsible for any incorrect or inaccurate information, including, without limitation, that caused by Web site users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of submissions in the Promotion. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Promotion. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel, modify or terminate the Promotion (or any portion thereof); (b) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (c) award the prizes from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor is not responsible for any technical or human error which may occur in processing entries for random drawings. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
